DYNAMIC ONLINE SELF STORAGE TERMS & CONDITIONS

1. Terms are cash, credit card (Visa, MC, Discover, and Amex) paid directly to the facility where the purchased property is located.
2. All bidders are required to register on www.AARbids.com.
3. Any bidder that purchases a Unit is doing so in "bulk" and must take entire contents.
4. The highest bidder at the close of the auction to be the buyer unless delinquent occupant has redeemed the unit in which case the potential sale is deemed null and void. Notwithstanding the foregoing, Manhattan Mini Storage, LLC reserves the right to reject any/all bids, as well as cancel or adjourn a sale, up until the winning bidder pays the winning bid and takes possession of the personal property. Manhattan Mini Storage, LLC expressly reserves the right to reject any/all bids, made by a delinquent occupant. If a bid is rejected, for any reason, the next highest bidder in the bidding history may be declared as the winning bidder.
5. 20% BUYERS PREMIUM will be added to the top bid to become part of the purchase price. BUYER’S PREMIUM DEFINITION: The Buyers Premium is that portion of the Auctioneer’s commission(s) that is being paid by the buyer. It is clearly understood and agreed by both the buyers and the seller that the Auctioneer represents the seller only.
6. All purchases shall be paid in full within 2 business days after the close of the Auction. Failure to pay for purchases as specified, may result in bidder being banned from future auctions, removal from contact list and the possible enforcement of all legal remedies available to Auctioneer and Seller by all applicable laws.
7. All lots are subject to New York Sales Tax unless a valid Tax Exemption Certificate is provided by the purchaser at the time of purchase to AAR.
8. Complete removal of all contents of a purchased unit shall be within 2 business days after the close of auction and within operating hours of storage facility. Purchaser forfeits all rights to all goods not removed within 2 business days after the close of auction and within operating hours of storage facility, and agrees that Manhattan Mini Storage, LLC may, at its election, resell or dispose of the goods without further notice to purchaser or any refund of monies paid.
9. All successful bidders shall post a $100.00 cash deposit per unit when they arrive to remove the contents of the unit(s) with the Self Storage site after the auction. Said deposit is to assure that bidders “broom-sweep clean” the unit at the point of removal of entire contents. The deposit shall be refunded, if, and when the unit(s) is completely cleaned out, or, the deposit shall be retained by owner as part of the clean up expenses if said buyer fails to clean the room out completely.
10. Ownership title passes upon payment and thereafter the property is at the risk of the buyer and neither the seller nor the Auctioneer shall be responsible for loss or damage.
11. Every unit contents is sold "As, is". Neither the auctioneer nor the seller makes any warranties or representations of any kind or nature with respect to said property. All sales are final.
12. Purchasers are responsible for any damages incurred during the removal of purchases.
13. Should a dispute arise after the auction, Auctioneers and Manhattan Mini Storage, LLC’s records shall be conclusive in all respects. No successful bidder should contact former occupant of unit for any reason. Failure to comply will result in being barred from bidding at future auctions.
14. No transfer of unit purchases shall be recognized from one buyer to another.
15. Auctioneer and/or Manhattan Mini Storage, LLC reserves the right to withdraw any unit prior to the completion of transaction and removal of contents.
16. Bidder agrees to pay any and all charges and expenses incurred by reason of any breach of terms and conditions of Auction, including without limitation reasonable attorney fees.
17. Auctioneer reserves the right to withdraw any item prior to the auction. These may include, but are not limited to, personal effects including photographs, paperwork (e.g. business and personal files), computer CPUs or external hard drives, computer media (disks, flash drives, etc.); and any items that may not be sold legally in an auction.
18. In the event that a sold space contains firearms, illegal or prescription drugs, hazardous materials, items with personal information (including without limitation Social Security numbers, credit or debit card information, bank-account information, passport information, and medical or legal records), or any items unlawful to sell at public auction, the buyer is required to surrender the items to the property owner.
19. Bidder does hereby agree to indemnify and hold harmless Auctioneer and Manhattan Mini Storage, LLC from any and all damages, claims, or liabilities from injuries to persons or property of any type whatsoever, caused during this auction process or by removal of the items purchased.
20. Manhattan Mini Storage, LLC reserves the right to bid at auctions.
21. The above stated conditions of Auction cannot be altered, except in writing by an officer of the Auctioneer.

23. Buyer agrees that they shall not to attempt to reverse any electronic payments for any reason whatsoever.
24. Any claim against Manhattan Mini Storage, LLC arising out of or related to this sale that is not brought within 12 months from the date the bidding closed is waived.
