LIVE SELF STORAGE TERMS & CONDITIONS

1. Terms are strictly cash.
2. No smoking anywhere in building.
3. All bidders are required to register and give full identification prior to the beginning of the auction and are required to use the number issued to them when identifying themselves as the successful bidder.
4. Any bidder that purchases a unit, is doing so in "bulk" and shall post a $100.00 deposit.
5. Units MUST be broom swept cleaned within five business days following the auction.. The deposit shall be refunded when the unit is completely cleaned out and the buyer’s lock is removed.
6. If a unit is not delivered empty, swept clean and without a lock by this deadline, the Seller’s remedy shall be to: Retain the cash deposit, destroy lock on door and retake ownership of the room contents as it will be deemed abandoned by buyer.
7. All lots are subject to Sales Tax of unless a valid Tax Exemption Certificate is provided by the purchaser.
8. The highest approved bidder to be the buyer. In all cases of disputed bids, the lot shall be resold, but the auctioneer will use his judgment as to the good faith of all claims and his decision is final.
9. If the auctioneer determines that any bid is not commensurate with the value of the unit offered, he may reject the same and withdraw the unit from the auction, and having acknowledged an opening bid, he decides that an advance is not sufficient, he may reject the advance.
10. Ownership of items in the unit (with the exception of that noted in line 16, below) passes to the buyer upon payment; thereafter the property is at the risk of the buyer and neither the seller nor the auctioneer shall be responsible for loss or damage.
11. The contents of every unit are sold "As, is, where is". Neither the auctioneer nor the seller makes any warranties or representations of any kind or nature with respect to said property. All sales are final.
12. All purchases must be paid in full by the close of the Auction and the buyer must place their own lock on the unit.
13. Purchasers are responsible for any damages incurred during the removal of purchases.
14. Should a dispute arise after the auction, auctioneer’s records shall be conclusive in all respects. No bidder should contact former owner of unit for any reason. Failure to comply will result in being barred from bidding at future auctions.
15. This is a privately owned and operated auction. We reserve the right to refuse admittance to any person(s). No transfer will be recognized from one buyer to another.
16. Auctioneer reserves the right to withdraw any item prior to the auction. These may include, but are not limited to, personal effects including photographs, paperwork (e.g. business and personal files), computer CPUs or external hard drives, computer media (disks, flash drives, etc.); and any items that may not be sold legally in an auction.
17. Bidder agrees that if they are a successful bidder on a unit, that they will attach their own lock immediately after bidding or forfeit their rights as a high bidder to that unit.
18. Bidder agrees to pay any and all charges and expenses incurred by reason of any breach of Terms and Conditions of Auction, including without limitation, reasonable attorney fees.
19. The above stated conditions of Auction cannot be altered, except in writing by an officer of the auctioneer.
20. Bidder does hereby indemnify and hold harmless Auctioneer and Seller from any and all damages, claims, or liabilities from injuries to persons or property of any type whatsoever caused during the auction or by removal of the items purchased.
21. BIDDERS MUST AGREE TO THE ABOVE TERMS & CONDITIONS OF THE AUCTION PRIOR TO RECEIVING A BID CARD.

 

MMS Policies and Procedures for September, 2020 Auction


In addition to Edison Properties' Policy on Preventing Spread of Covid-19, which have been adopted by Manhattan Mini Storage LLC ("MMS") in all of its facilities, the below policies and procedures have been enacted to govern the conduction of auctions at all MMS facilities in September, 2020. All visitors who wish to participate must read and acknowledge receipt of these policies and procedures (along with any auction rules that may be presented) prior to the start of the first auction in which they wish to participate, and MMS reserves the right to ban anyone found to be in violation of any of these policies and procedures from current and future auctions at any of its facilities without notice and in MMS' sole discretion.

1. Only registered bidders will be allowed at the auction-NO GUESTS
2. All bidders will be screened daily, in accordance with existing MMS visitor screening procedures. Bidders who pass the screening will be provided with a color-coded wrist band at the first auction they attend each day. The wrist-band must be worn for the duration of any and all MMS auctions which the bidder attends on that day, and displayed upon request to any employee on duty in an MMS facility. There will be only one color wrist band used for each day of auction.
3. The following rules will govern behavior of participants and their movement throughout MMS facilities in conjunction with September auctions:
a. At the start of auction at each location, groups of buyers will be transported in elevators carrying no more than 50% maximum occupancy to highest floor on which a unit is scheduled for auction.
b. Buyers will be required to wear face coverings at all times, stay in single file line for viewing and transit between units, and maintain 6' distance between themselves and others wherever and whenever possible.
c. Auctioneer and MMS personnel will lead the line of buyers to each unit to be viewed/sold. Buyers will be limited to 15 seconds each when viewing units. After viewing, buyers will continue in single file line to end of the aisle or an open area away from the unit, following direction of MMS personnel at all times.
d. All bidding will be conducted in an area which allows for distance to be maintained between auctioneer, manager, and bidders at all times. At MMS' sole discretion, buyers interested in bidding on unit{s) after viewing will be gathered in either 1) the nearest area to each unit with space considered in MMS' sole discretion to be sufficient, or 2) another area on the main floor, in the event that bidding for multiple units will occur in a single location.
e. Bidding will be silent, with bidders given cards to raise when they wish to make a bid. Bidders will not be allowed to talk to each other during the bidding process.
f. When moving between floors in MMS buildings, travel from the top floor down will be via stairs whenever possible. Buyers who need to use an elevator to go from floor to floor will be allowed to do so, and will then join the end of the single file line on the new floor once all buyers who took stairs have arrived.
g. When units in basement will be auctioned, use of elevators to return to the main floor will be in accordance with occupancy requirements described above.
h. After auctions are complete, no more than two buyers will be allowed in MMS' lobby to make payment at the same time.
